San Antonio City Code Chapter 21, Article IX establishes a juvenile curfew making it an offense for a minor under 17 to remain in any public place or establishment during curfew hours. Nighttime curfew runs 11:00 PM to 6:00 AM Sunday through Thursday and midnight to 6:00 AM Friday and Saturday. A separate daytime curfew prohibits compulsory-attendance minors from public places between 9:00 AM and 2:30 PM on official school days.
Defenses include accompaniment by a parent or guardian, parental errands, interstate travel, lawful employment, emergency response, attending an official school or religious event, First Amendment exercise, presence on the sidewalk of the minor's residence, and emancipation. SAPD operates a Curfew Center where detained minors are released to parents.
A violation is a Class C misdemeanor with a fine up to $500. Parents and establishment owners who knowingly permit a violation face the same fine. Courts may order community service or diversion.
