Full Breakdown

The curfew is Municipal Code § 70-76 (Curfew for children), in Article III (Minors) of Chapter 70. Subsection (a)(1) provides that no person under the age of 18 years shall be or remain in or upon any of the public streets, alleys or places of the city between the hours of 11:00 p.m. and 5:00 a.m. The curfew has two built-in outs: the minor is accompanied by a parent, guardian or other person of full age having custody, or the minor is in the process of returning directly to home when confronted by a police officer.

Subsection (a)(3) adds exemptions for a minor who is required to use the streets, alleys or public places during the curfew hours to go to or return from a place of employment, who is engaged in the performance of a necessary errand, or who is in the immediate view and vicinity of home. The code allows no more than reasonable time for going to and returning from the job or the errand. The heading of subsection (a) reads "Children 14 to 18 years of age", while the operative sentence in (a)(1) is worded for any person under 18.

Children under 14 are handled separately in subsection (b). Any person under the age of 14 found on the streets, alleys or public places in violation of the section can be taken into custody by any police officer and forthwith taken home. A child under 14 who has once been taken home and then violates the section again is subject to W.S.A. ch. 48.

Parents carry their own duty under § 70-77. No parent, guardian or other person having legal custody or entrusted with the care of a child under 18 can permit the child to loiter, linger or remain upon the streets, alleys or other public places between 11:00 p.m. and 5:00 a.m. the next day unless the child is accompanied by a parent, guardian or other adult with legal custody. The parental section has its own exceptions: being in the immediate view and vicinity of home, going to or returning from employment or a necessary errand in a reasonable amount of time, or returning from a school-sponsored event in a reasonable amount of time.

Violations & Fines

A minor who violates § 70-76(a) is subject to a forfeiture of not less than $10.00 or more than $25.00. A parent, guardian or custodian who violates § 70-77 is subject to a forfeiture of not less than $50.00 or more than $200.00, together with the costs of prosecution, and in default of payment to county jail for a period not to exceed 30 days. A repeat violation by a child under 14 who was already taken home falls under W.S.A. ch. 48.

Frequently Asked Questions

What time is the curfew for minors in Sheboygan?
Section 70-76(a)(1) runs from 11:00 p.m. to 5:00 a.m. and applies to any person under the age of 18 on the public streets, alleys or places of the city. The same hours appear in § 70-77(a), which puts a matching duty on parents and guardians. The code prints one set of hours and does not separate weekends from school nights.
Can a minor be out after 11 p.m. with a parent in Sheboygan?
Yes. The curfew in § 70-76(a)(1) does not apply to a minor accompanied by a parent, guardian or other person of full age having custody. A minor who is in the process of returning directly home when confronted by a police officer is also outside the prohibition.
Is working a late shift an exception to the Sheboygan curfew?
Yes. Section 70-76(a)(3) exempts a person under 18 who is required to use the streets, alleys or public places during the curfew hours to go to or return from a place of employment. The code allows no more than reasonable time for the trip, and it also exempts a necessary errand and being in the immediate view and vicinity of home.
What happens to a child under 14 found out after curfew in Sheboygan?
Under § 70-76(b)(1), a police officer can take the child into custody and forthwith take the child to the child's home. If the child has once been taken home and violates the section again, § 70-76(b)(2) subjects the child to W.S.A. ch. 48 rather than to the forfeiture set for older minors.
Can parents be fined for a curfew violation in Sheboygan?
Yes. Section 70-77(b) provides a forfeiture of not less than $50.00 or more than $200.00, together with costs of prosecution, for a parent, guardian or custodian who permits a child under 18 to loiter, linger or remain on public places between 11:00 p.m. and 5:00 a.m. Default of payment can bring up to 30 days in the county jail.
