Walnut Creek Municipal Code Β§4-2.202 establishes a curfew for minors under 18: prohibited in public places between 11:00 PM and 5:00 AM Sunday-Thursday, and midnight to 5:00 AM Friday-Saturday. Exceptions for minors with parents, returning from work or school events, or emergencies.
Walnut Creek's juvenile curfew ordinance (WCMC Β§4-2.202) prohibits persons under 18 years of age from loitering, wandering, or being present in public places, businesses open to the public, or establishments serving the public between 11:00 PM and 5:00 AM Sunday through Thursday, and between midnight and 5:00 AM on Friday and Saturday nights. Enumerated exceptions: (1) minors accompanied by parent, legal guardian, or responsible adult 21+; (2) travel to/from legitimate employment with employer documentation; (3) travel to/from school, religious, or civic events sanctioned by adults; (4) emergencies requiring immediate travel; (5) exercising First Amendment rights; (6) on the sidewalk immediately in front of the minor's residence or a neighbor's with neighbor consent. Violations are infractions punishable by fines up to $100 first offense, $200 second, $500 third, and mandatory parent conferences. Repeat offenders and accompanying minors may be referred to Contra Costa County Probation's juvenile diversion program. Parents who knowingly permit curfew violations may be cited under WCMC Β§4-2.203 parental responsibility provisions. Curfew does not apply to emancipated minors.
