Chapter 162, § 162-5 of the Town Code sets the default hours for all Town recreational areas, defined in § 162-3 to include parks, playgrounds, athletic fields, boat-launching ramps and similar facilities owned, leased or operated by the Town of Greece. m. The Commissioner of Public Works has authority to extend access hours when, in the Commissioner's judgment, public interest demands it, and the Town Board sets opening and closing hours by resolution, with the Commissioner required to post notice of those hours at each recreational area.
Section 162-5B goes further and allows the Town Board, the Supervisor or the Commissioner to close any portion of a park to the public or to designated persons during an emergency or whenever the public interest demands it, until permission is given to reopen. Overnight parking in the parks is separately banned under § 162-7D, reinforcing the after-hours closure. Enforcement runs through § 162-10, which lets any law enforcement officer arrest a person found in a recreational area who has violated the chapter or any rules promulgated under it, and penalties are set out in § 162-11.

Being in a Town recreational area outside posted hours, or violating a closure order, is enforceable under § 162-10, which authorizes arrest by any law enforcement officer for violations of Chapter 162. Section 162-11A sets the penalty at a fine of no more than $500 and/or imprisonment not to exceed 15 days, and § 162-11B adds that a court may also order restitution or public-service work for the Department of Public Works under New York Penal Law § 65.10 and Family Court Act § 758-a.
