Winter Haven, FL Curfew Laws: Park Curfew (2026)

Winter Haven Code of Ordinances § 15-288 governs when a city park is open. Subsection (a) requires parks to stay open to the public every day of the year "except for unusual and unforeseen emergencies," but it does not fix a single citywide curfew hour: instead the opening and closing hours for each individual park are set and posted at that park, so a schedule at the Chain of Lakes Complex can differ from one at a neighborhood playground. Subsection (b) lets the parks and recreation director close any section of any park, entirely or to certain uses, temporarily or on a recurring basis, whenever the director finds it reasonably necessary, which covers everything from a storm closure to a nightly lock on a specific facility.

Subsection (c) puts the City Manager, the director and park attendants in charge of enforcing the article and any rules adopted under it. The next section, § 15-289, backs that authority: the director may adopt written rules on file at the City Clerk's office, eject anyone violating the article or those rules, and deny park access to a repeat violator, provided the denial is applied fairly. A person denied access for more than one week can appeal to the City Manager, whose decision is final.

Because § 15-288 does not itself set a dollar fine, a violation of the posted hours or a director's closure falls back on the Code's general penalty clause, § 1-13, which caps an unspecified-penalty offense at a $500 fine and treats each day of a continuing violation as a separate offense.
