Florida law preempts local drone rules, so Sunrise has no recreational drone ordinance. Recreational flyers follow FAA requirements: register drones over 0.55 lbs, stay below 400 feet, keep visual line of sight, and pass the free TRUST test.
Fla. Stat. §330.41(3), the Unmanned Aircraft Systems Act, bars any Florida city or county from enacting ordinances on drone operation, altitude, flight paths, or registration, so Sunrise cannot and does not regulate recreational drone flight. Recreational operators answer to the FAA: register any drone over 0.55 pounds, fly below 400 feet within visual line of sight, avoid controlled airspace, and pass the free TRUST aeronautical test. Fla. Stat. §934.50, the Freedom from Unwarranted Surveillance Act, separately bars using a drone to record someone on private property in violation of their reasonable expectation of privacy. Sunrise keeps only narrow authority over drone takeoffs and landings on city-owned parks.
FAA penalties for unsafe recreational operation reach $27,500 or more per incident, and criminal charges apply near airports. Illegal drone surveillance under Fla. Stat. §934.50 exposes the operator to civil damages and injunctive relief.
