Kenai Peninsula Borough, AK Environmental Rules: Boat Dock Permits (2026)

Within the Kenai Peninsula Borough's anadromous waters habitat protection district, the 50-foot buffer along the Kenai River and other cataloged salmon waters set by KPB 21.18.040, a dock or boat launch is not a staff-level permit like routine landscaping; KPB 21.18.081(B)(9) makes a private boat launch and its related facilities a conditional use requiring planning commission approval. The applicant must submit a plan of operation covering hours and season of operation, daily boat launch capacity, a parking plan, the types of boats and clients served, fees charged, the location of other public boat launches on the same water, and any ancillary facilities such as restrooms or storage sheds.

The launch must stay open to the public without exclusive membership, and once it stops serving the public as described in that plan, KPB 21.18.081(B)(9)(c) requires the owner to remove it and revegetate or otherwise mitigate the site. A conditional use permit issued under this subsection expires two years after it is granted unless the planning commission approves a renewal showing the applicant still complies with the original conditions. A separate, narrower path exists for strictly commercial docks: KPB 21.18.072(B)(1) allows the planning commission to permit a dock and boat launch as an allowed commercial activity, but only within a defined stretch of the Kenai River near river miles 1 to 3.5.

Private boat launches restricted to the owner's own use on anadromous lakes with no public launch follow a different conditional use track under KPB 21.18.081(B)(12), capped at a 12-foot-wide launch approach.
