Dakota County, MN Environmental Rules: Erosion Control (2026)

Ordinance No. 04, "Topographic Alterations/Grading and Filling," is the county's erosion and sediment control standard for construction-related land disturbance in unincorporated shoreland. Subsection D lists the conditions attached to building permits, shoreland alteration permits, conditional use permits and variances involving grading or filling. 2, alterations must be designed and conducted so only the smallest amount of bare ground is exposed for the shortest time possible. 3 requires all land-disturbing activities to comply with the Minnesota Pollution Control Agency's Construction Stormwater General Permit, which Ordinance No.

50 incorporates by reference. 4 requires altered areas to be stabilized to acceptable erosion control standards set by the zoning administrator, consistent with the MPCA Construction Stormwater Manual. 7 add related fill-stability rules: fill or excavated material cannot create an unstable slope, plans to place fill on steep slopes need review by a qualified professional and cannot create finished slopes of 30 percent or greater, and fill cannot be placed in bluff impact zones at all. 04(C) whenever grading or filling disturbs more than five cubic yards of material on steep slopes or within shore and bluff impact zones, or more than 50 cubic yards outside those zones; any amount of disturbance in the Cannon Recreational and Scenic River Districts triggers the permit requirement. 02(B)(4).
