Under the HBMC Grading and Excavation Code, all grading operations must include erosion control measures. Grading permits shall not be renewed until an erosion control system approved by the Director is installed. Land conditions resulting from grading that cause erosion, subsidence, or surface water drainage problems are designated nuisances under HBMC Chapter 17.10. The city's National Pollutant Discharge Elimination System (NPDES) permit requires construction sites to implement best management practices for sediment and erosion control.
Failure to maintain erosion control is a nuisance violation under HBMC 17.10. Grading permits will not be renewed without an approved erosion control system.
