Louisburg, KS Environmental Rules: Erosion Control (2026)

Section 4-1001 (Ord. 1157) incorporates by reference the city's own Erosion and Sediment Control Standards for Building Construction on less than 1 Acre, adopting each and all of the regulations, provisions, penalties, conditions and terms of that document as if fully written into the code. It governs construction-related activity disturbing under one acre that would not otherwise trigger a separate Land Disturbance Permit, and requires the builder to secure permits and pay fees under the standards. Copies of the adopted standards are kept on file in the Building & Zoning office for anyone who wants to review the specific control measures before starting work.

Section 4-1003 adds a disclaimer that adopting the standards does not affect any pending lawsuit, any right already acquired, or any liability already incurred under prior ordinances, and does not impair any existing legal remedy. Because the standards themselves are adopted as a separate on-file document rather than printed inside the code chapter, a contractor or homeowner planning grading or building work on a parcel under an acre should request a copy from the Building & Zoning office to see the specific sediment barrier, silt fence or drainage requirements that apply to a given site before requesting the necessary permit.
