Summary

In unincorporated St. Martin Parish, Louisiana, a building permit site larger than one acre needs a stormwater pollution prevention plan (SWPPP) that identifies sediment sources and sets best management practices, under St. Martin Parish Code § 8-52. Smaller sites inside a larger common plan of development count too, and all construction operations must follow the plan as a condition of the permit.

These county ordinances apply to unincorporated areas of St. Martin Parish. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)A stormwater pollution prevention plan (SWPPP) shall be for each building permit site larger than one acre or which forms a portion of a group of sites greater than one acre.(b)A SWPPP must be prepared if activities disturb one acre or more, including smaller sites in a larger common plan of development.(c)The SWPPP shall be prepared in accordance with good engineering practices and must be completed in accordance with any applicable requirements of the Louisiana Department of Environmental Quality and the Environmental Protection Agency. The plan shall identify potential sources of pollution (including sediment) which may reasonably be expected to affect the quality of stormwater discharges associated with the land disturbance activity. In addition, the plan shall describe and ensure the implementation of best management practices (BMP's) which will be used to reduce the pollutants in stormwater discharges associated with activity. All construction operations must implement the provisions of their SWPPP as a condition of their permit.

Full Breakdown

Erosion control in unincorporated St. Martin Parish runs through the stormwater runoff article of the building chapter, Ord. No. 14-10-1075, adopted October 7, 2014. Sec. 8-12 lists the first objectives as erosion and sediment controls and construction site waste control, and Sec. 8-13 applies the article to all land disturbing activities, including all sites requiring a building permit, even sites under one acre when they are part of a larger common plan of development. Sec. 8-14 exempts, among others, construction disturbing less than one acre outside a larger plan, agricultural operations, forestry land management practices, and any project involving 5,000 square feet or less of disturbed area, though that last exemption does not reach activity within a larger common plan of one acre or more.

The permit gate is Sec. 8-42: no land owner or land operator receives a building, grading or other land development permit for land disturbance without first meeting the article's requirements. Sec. 8-43 requires a notice of intent to the Louisiana Department of Environmental Quality, if required, plus a SWPPP, and a copy must be available for review at all times at the construction site. Sec. 8-17 requires plans to be certified by a licensed Louisiana professional engineer. The review fee for a land development application is $500.00 and the fee for site development is $250.00 under Sec. 8-44.

Sec. 8-52(c) requires the plan to identify potential sources of pollution, including sediment, and to describe the best management practices that will reduce pollutants in stormwater discharges. Sec. 8-53 lists nine required elements, from the cover page and site map to inspection records, SWPPP amendments and certification. Under Sec. 8-52(e), landscaping, earthmoving before foundation excavation, parking and sidewalks beyond a previously developed SWPPP need a separate one. Fill placed in a flood hazard area must be protected against erosion with rip-rap, vegetation covers, hydro-mulch, erosion control matting or bulk heading under Sec. 14-66(a)(8). Sec. 8-71 lets the parish inspect without a warrant.

Violations & Fines

Under Sec. 8-81(c)(1), a permit for land disturbance can be suspended immediately for a violation. Sec. 8-82 lets the parish serve a notice of violation requiring a written explanation and correction plan within seven days, and after seven days without correction it can issue a stop work or cease and desist order. Under Sec. 8-83, civil penalties are capped at $1000.00 per violation per day, and a willful or malicious violation is a misdemeanor with a fine not exceeding $1000.00 and/or imprisonment for not more than 30 days.

Frequently Asked Questions

Does a site under one acre need a SWPPP?
Section 8-52(b) requires a SWPPP when activities disturb one acre or more, including smaller sites in a larger common plan of development. Section 8-14 exempts construction that disturbs less than one acre outside such a plan, and any project involving 5,000 square feet or less of disturbed area, unless it sits within a larger common plan of one acre or more.
Who prepares and certifies the plan?
Section 8-51(b) requires the plan to be prepared by a competent individual who verifies that the stormwater management practices meet the article. Section 8-17 requires plans for construction sites to be certified by a licensed Louisiana professional engineer and reviewed by the parish, and Sec. 8-43 requires a copy of the SWPPP at the construction site at all times.
What must the SWPPP contain?
Section 8-53 lists nine elements, consistent with the latest EPA SWPPP Template: a cover or title page, project and SWPPP contact information, a site and activity description with site map, potential pollutant sources, controls to reduce pollutants, maintenance and inspection procedures, inspection and BMP maintenance records, SWPPP amendments, and SWPPP certification.
Can the parish inspect my construction site?
Yes. Section 8-71 authorizes St. Martin Parish to inspect without a warrant, and landowners and land operators must make available all records required by the permit or the article. Section 8-72 adds a right of entry at reasonable times when a new drainage control facility is installed, and Sec. 8-81(b) lets the parish seek a search warrant if access is refused.
