Summary

New residential, nonresidential and manufactured home structures in a special flood hazard area of unincorporated St. Martin Parish, Louisiana must have the lowest floor one foot above the higher of three measurements: the FEMA base flood elevation, the centerline of the nearest street, or the highest recorded or modeled 100-year inundation level. St. Martin Parish Code § 14-66(b) sets the freeboard rule.

These county ordinances apply to unincorporated areas of St. Martin Parish. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(b)Freeboard requirements: In all areas of special flood hazard the following provisions are required for all new construction and substantial improvements: (1)All new residential, nonresidential and manufactured home structures, and any substantial improvements related to the same shall have the minimum lowest floor elevation be one foot above the higher of the following three measurements:a.Base flood elevation as determined by the latest flood insurance rate map (FIRM) as issued by the FEMA;b.Centerline of the nearest street across from or adjacent to the structure; orc.Highest recorded historical or modeled (100-year) inundation levels.(2)All mechanical equipment must also comply with the above minimum lowest floor elevation requirements.(3)Should the above freeboard calculation requirement result in an unreasonable elevation, a waiver may be requested.(4)A licensed land surveyor or engineer will be required to certify (2) and (3) above through the use of the freeboard elevation form.

Full Breakdown

The freeboard rule in Sec. 14-66(b) applies in all areas of special flood hazard to all new construction and substantial improvements. The minimum lowest floor elevation is one foot above the higher of three measurements: the base flood elevation from the latest FIRM issued by FEMA, the centerline of the nearest street across from or adjacent to the structure, or the highest recorded historical or modeled (100-year) inundation level. All mechanical equipment must meet the same minimum. If the calculation produces an unreasonable elevation, a waiver can be requested, and a licensed land surveyor or engineer certifies the result on the freeboard elevation form, which is available at the St. Martin Parish Government building, 400 Port Street, St. Martinville.

Sec. 14-67 carries the rule into each building type. Residential construction must have the lowest floor, including a basement, elevated to freeboard, attached garages and utilities must meet the same requirement, and a registered professional engineer, architect or land surveyor certifies compliance to the floodplain administrator. Nonresidential buildings must elevate the lowest floor, including basement and garage or carport, to freeboard, or be designed watertight below the base flood level with engineer or architect certification. Manufactured homes in an existing park or subdivision are measured from the bottom of the lowest longitudinal frame beam. Fully enclosed areas below the lowest floor need at least two openings on separate walls with a total net area of not less than one square inch for every square foot of enclosed area, the bottoms no higher than one foot above grade.

Accessory structures get a narrow alternative. Under Sec. 14-67(4), an accessory structure used only for parking or limited storage and no larger than 1,500 square feet can be wet floodproofed instead of elevated, with electrical service of 60 amps or less at least one foot above the BFE; anything larger must be elevated one foot above the BFE. In AO and AH shallow flooding zones, Sec. 14-69 requires the lowest floor at least one foot above the base flood elevation or the highest adjacent grade at least as high as the FIRM depth number, and at least two feet if no depth number is specified. The plat statement under Sec. 14-68(h) excludes garages, carports and porches from the one foot rule and places them at a minimum of six inches above the base flood elevation.

Violations & Fines

A failure to meet the elevation requirements is a violation under Sec. 14-13: a misdemeanor punishable on conviction by a fine of not more than $100.00 or imprisonment for not more than 30 days, or both, for each violation, with each day a new violation and the violator paying costs. A variance applicant receives written notice under Sec. 14-46(j)(3) that the structure will be permitted with the lowest floor below the base flood elevation and that flood insurance cost will be commensurate with the increased risk.

Frequently Asked Questions

How high must the lowest floor of a new house be?
Section 14-66(b)(1) sets the minimum lowest floor elevation at one foot above the higher of three measurements: the base flood elevation on the latest FIRM issued by FEMA, the centerline of the nearest street across from or adjacent to the structure, or the highest recorded historical or modeled (100-year) inundation level. Mechanical equipment must meet the same minimum.
Can the freeboard requirement be waived?
Section 14-66(b)(3) says that if the freeboard calculation results in an unreasonable elevation, a waiver may be requested. A licensed land surveyor or engineer must certify the elevation requirements and the waiver through the freeboard elevation form, which is available from the St. Martin Parish Government building at 400 Port Street, St. Martinville.
Does a commercial building have to be elevated too?
Yes. Section 14-66(b)(1) covers nonresidential structures, and Sec. 14-67(2) requires the lowest floor, including basement and garage or carport, to be elevated to freeboard. The alternative is a design that is watertight below the base flood level with walls substantially impermeable to water, developed or reviewed and certified by a registered professional engineer or architect.
Can a detached garage or shed be wet floodproofed instead of elevated?
Under Sec. 14-67(4), an accessory structure limited to parking or limited storage, with no human habitation, can be wet floodproofed if it is no larger than 1,500 square feet. Electrical service must be 60 amps or less and at least one foot above the BFE, and the structure must have flood-resistant materials and the required openings.
