Section 11.45 sets the Regulatory Flood Protection Elevation (RFPE) at not less than one foot above the elevation of the regional flood, adjusted for any floodway encroachments (Subd. 3, Definitions). In the Flood Fringe District, Subd. 6.B.1 requires that all structures, including accessory structures, be elevated on fill so the lowest floor sits at or above the RFPE, with finished fill no lower than one foot below the RFPE and extending at least fifteen feet beyond the structure's outside limits. Non-residential basements below the RFPE must be dry floodproofed to FP1 or FP2 State Building Code standards (Subd.

6.D.3), while residential basements below the RFPE are barred outright (Subd. 6.D.2.a). A Land Alteration or Building Permit from the City Engineer is required before any erection, addition, or fill placement in a floodplain district (Subd. 11.B.1), and on completion the permit holder must submit certification from a registered engineer, architect or land surveyor confirming the finished fill and building elevations comply (Subd. 11.B.4). Stat. § 462.357 and City Code § 11.76 and cannot permit a lower degree of flood protection than the RFPE; the City Engineer must warn any variance applicant that building below the base flood level raises flood insurance premiums by as much as $25 per $100 of coverage (Subd. 11.C.4).
