1, added when Newark rewrote Title XII in its entirety on March 24, 2020, by Ordinance No. 6PSF-A, sets the elevation standard for residential structures in mapped special flood hazard areas. In AO or AH zones, the structure must clear the depth number shown on the municipality's FIRM plus one foot above the highest adjacent grade, with a three foot minimum if no depth number is mapped, and the design must route drainage around the structure on sloped sites. 2 applies a parallel standard to commercial, industrial and other nonresidential structures, but lets an owner choose floodproofing instead of elevation: the space below the freeboard-adjusted base flood elevation must be watertight, substantially impermeable to water, and able to resist hydrostatic and hydrodynamic loads and buoyancy, certified by a registered professional engineer or architect. Section 12:4-5 separately requires any enclosed area below the lowest floor used only for parking, access or storage to have flood vents totaling at least one square inch of net opening per square foot of enclosed area, with the lowest opening no higher than one foot above grade, so floodwaters can enter and exit without damaging the structure.
Violations & Fines
Building or substantially improving a structure below the required freeboard elevation violates Title XII and is enforced the same way as any other flood-title violation: Section 12:2-4 makes it a misdemeanor punishable by a fine of up to $300 for each day the violation continues, imprisonment up to 90 days, or both, plus case costs. A structure built too low also cannot receive the Elevation Certificate the Flood Control Compliance Officer must record under Section 12:3-5, which can block a certificate of occupancy and raise flood insurance costs.
