Summary

In the City of Plainfield the Local Design Flood Elevation (LDFE) for a delineated watercourse is the best available flood hazard elevation plus one foot of freeboard, or as described by N.J.A.C. 7:13. In Zone AO areas it is the highest adjacent grade plus the depth number plus one foot, or three feet above grade if no depth is given.

A. The Local Design Flood Elevation (LDFE) is established in the flood hazard areas determined in Section 17:9-30.102.2, above, using the best available flood hazard data sources, and the Flood Hazard Area Control Act minimum Statewide elevation requirements for lowest floors in A, Coastal A, and V zones, ASCE 24 requirements for critical facilities as specified by the building code, plus additional freeboard as specified by this chapter. At a minimum, the Local Design Flood Elevation shall be as follows: 1. For a delineated watercourse, the elevation associated with the Best Available Flood Hazard Data Area determined in Section 17:9-30.102.2, above plus one foot or as described by N.J.A.C. 7:13 of freeboard; or ... 3. AO Zones - For Zone AO areas on the municipality's FIRM (or on preliminary flood elevation guidance from FEMA), the Local Design Flood Elevation is determined from the FIRM panel as the highest adjacent grade plus the depth number specified plus one foot of freeboard. If no depth number is specified, the Local Design Flood Elevation is three feet above the highest adjacent grade.

Full Breakdown

Section 17:9-30.102.3 of the Plainfield Municipal Code establishes the Local Design Flood Elevation (LDFE) in the City of Plainfield. It is set using the best available flood hazard data, the Flood Hazard Area Control Act minimum Statewide elevation requirements for lowest floors in A, Coastal A, and V zones, and ASCE 24 requirements for critical facilities, plus additional freeboard as specified by the chapter. The ordinance is Ord. No. MC 2023-06, adopted 4-10-2023.

The minimums depend on the watercourse. For a delineated watercourse, the LDFE is the Best Available Flood Hazard Data Area elevation plus one foot, or as described by N.J.A.C. 7:13, of freeboard. For an undelineated watercourse with a contributory drainage area of 50 acres or more, the applicant provides either an unexpired NJDEP Flood Hazard Area Verification plus one foot of freeboard and any additional freeboard required by ASCE 24, or a design flood elevation by Method 5 or Method 6 plus one foot of freeboard, sealed and submitted under § 17:9-30.105.2-3. In Zone AO areas the LDFE is the highest adjacent grade plus the depth number specified plus one foot of freeboard, and where no depth number is specified it is three feet above the highest adjacent grade.

Critical facilities carry more. A new or substantially improved Class IV critical facility must sit at the higher of the 0.2% annual chance (500-year) flood elevation or the Flood Hazard Area Design Flood Elevation with an additional two feet of freeboard. Class III facilities in coastal high hazard areas use the same comparison with one additional foot of freeboard.

Where design flood elevations are not specified, § 17:9-30.103.7 lets the Floodplain Administrator, who is the Zoning Officer, require the applicant to use Federal or State data or to determine the elevation through an analysis sealed by a licensed professional engineer.

Violations & Fines

A building without documentation of the elevation of its lowest floor, or other required design certifications, is presumed to be a violation under § 17:9-30.108.1 until the documentation is provided. Under § 17:9-30.101.8 a violator faces a fine of not more than $1,250, imprisonment not exceeding 90 days or community service not exceeding 90 days, with each day a separate violation after a thirty-day cure period. After that period a fine greater than $1,250 can be imposed.

Frequently Asked Questions

How much freeboard does the City of Plainfield require?
For a delineated watercourse, one foot above the best available flood hazard elevation, or as described by N.J.A.C. 7:13. Undelineated watercourses of 50 acres or more also use one foot plus any additional freeboard ASCE 24 requires. Zone AO areas add one foot to the highest adjacent grade plus the depth number. Class IV critical facilities add two feet.
What is the Local Design Flood Elevation in a Zone AO area in Plainfield?
Take the highest adjacent grade from the FIRM panel, add the depth number specified, and add one foot of freeboard. If the FIRM specifies no depth number, the Local Design Flood Elevation is three feet above the highest adjacent grade. Section 17:9-30.102.3 applies this to Zone AO areas on the City's FIRM or on preliminary FEMA flood elevation guidance.
What if my site has a stream that is not on the FEMA map in Plainfield?
For an undelineated watercourse with a contributory drainage area of 50 acres or more, you provide an unexpired NJDEP Flood Hazard Area Verification or a Method 5 or 6 determination under N.J.A.C. 7:13, plus one foot of freeboard. Any Method 5 or 6 determination must be sealed and submitted under § 17:9-30.105.2-3.
Who checks the design flood elevation on a Plainfield permit?
The Floodplain Administrator, who is the Zoning Officer, verifies that the applicant's Best Available Flood Hazard Data Area and Local Design Flood Elevation in the development permit apply the best available data and the methods in §§ 17:9-30.102.2 and 17:9-30.102.3. That information goes to the Construction Official and is documented in the permit record.
