Sec. 14-1-1 cites Wis. Stat. Sec. 61.35 and Sec. 62.23 for village zoning authority and Sec. 87.30 for floodplain zoning. Sec. 14-1-7 divides regulated areas into the Floodway District (FW), Floodfringe District (FF), and General Floodplain District (GFP), corresponding to A, AE, AH, AO, and A1-30 zones on the FIRM. Sec. 14-1-5 defines Flood Protection Elevation as 2 feet of freeboard above the Regional Flood Elevation. Sec. 14-6-1(B)(8) requires substantially damaged residential nonconforming structures to be rebuilt with the lowest floor (including basement) elevated to or above the Flood Protection Elevation, anchored against flotation, and with flood-resistant materials. Sec. 14-6-2 prohibits modifications or new wells in the Floodway District unless the addition is floodproofed without fill to the Flood Protection Elevation and does not increase regional flood height. Sec. 14-6-3 in the Floodfringe District prohibits any floor below the Regional Flood Elevation for residential or commercial structures and limits flood depths and velocities for variances. Sec. 14-1-9 allows removal of land from the floodplain only if filled at least 2 feet above the regional or base flood elevation and FEMA issues a Letter of Map Revision under 44 C.F.R. 70 / Wis. Stat. Sec. 87.30(1)(e). Sec. 17-8-600 of the Zoning Code cross-references Chapter 14, Article VI, for floodplain districts. The Fox River and Dutchman Creek are principal regulated waterways. Manufactured homes (Sec. 14-6-1(D)(9)-(10)) must be elevated to or above the base flood elevation and anchored. Recreational vehicles (Sec. 14-6-1(D)(11)) must be on site fewer than 180 consecutive days or be fully licensed and ready for highway use.
Sec. 14-1-10 makes any structure or use located, constructed, repaired, extended, or altered without full compliance and a floodplain permit a violation. Penalties are in Article 10 of Chapter 14. Sec. 17-9-200 of the Zoning Code authorizes the Village Attorney to seek injunction, mandamus, abatement, or removal, with forfeitures under the Sec. 1-1-13 bond schedule. Wis. Stat. Sec. 87.30(2) requires local enforcement, and noncompliance can lead to suspension from the National Flood Insurance Program under 44 CFR Part 59.
