Full Breakdown
Rio Rancho maps its special flood hazard areas from FEMA's 2008 Sandoval County and 2012 Bernalillo County Flood Insurance Studies (§ 152.06), since the city sits in both counties. Before development starts in one of those areas, § 152.45(B) requires an application to the Flood-Plain Administrator showing lowest-floor elevation, floodproofing elevation, distance to the nearest drainage channel, and either a Clean Water Act 404 permit/nonjurisdictional letter or an Endangered Species Act exclusion checklist. The Administrator weighs danger to life and property, flood or erosion susceptibility, and emergency-vehicle access before approving or denying. Initial applications cost $150; a resubmittal costs $266.
Violations & Fines
Developing in a mapped flood or erosion hazard area without an approved permit is punishable by a fine up to $500, up to 90 days in jail, or both, with each day counted as a separate offense under § 152.99.
