Summary

Any development in a mapped A, AE, AO, or AH flood zone in Wyandotte County/Kansas City, Kansas requires a floodplain development permit before work starts, under Code § 27-550, administered by the director of planning as floodplain administrator.

These county ordinances apply to unincorporated areas of Wyandotte County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)Lands to which this subdivision applies. This subdivision shall apply to all lands within the jurisdiction of the city identified as numbered and unnumbered A zones, AE, AO, and AH zones, on the index map dated September 2, 2015 of the flood insurance rate map (FIRM) as amended and any future revisions thereto. In all areas covered by this subdivision, no development shall be permitted except through the issuance of a floodplain development permit, granted by the unified government board of commissioners or its duly designated representative under such safeguards and restrictions as unified government board of commissioners or the designated representative may reasonably impose for the promotion and maintenance of the general welfare, health of the inhabitants of the community, and as specifically noted in this subdivision.

Full Breakdown

Section 27-550 applies the floodplain subdivision to every parcel identified as a numbered or unnumbered A zone, AE, AO, or AH zone on the FIRM index map dated September 2, 2015, as amended. No development, including grading, filling, or placing a manufactured home, may proceed in those zones without a floodplain development permit issued by the unified government board of commissioners or its designee, and § 27-551 makes the director of planning the floodplain administrator responsible for reviewing every application. An applicant must describe the land by lot and address, identify the work, state the assessed value and fair market improvement value, disclose whether the site sits in the floodway or flood fringe, and supply the existing base flood elevation alongside the elevation of the proposed development.

The administrator also coordinates with the Kansas Division of Water Resources before any watercourse is altered or relocated and keeps records of the certified lowest-floor elevation for every new or substantially improved structure. Storage of buoyant, flammable, or explosive material in the special flood hazard area is flatly prohibited under § 27-552(a)(5), and any nonconforming structure that goes unused for 18 consecutive months loses its nonconforming status.

Violations & Fines

Section 27-554 makes violating any provision of the floodplain subdivision, including breaking a variance condition, a misdemeanor punishable by a fine of not more than $500.00 plus case costs and expenses, with each day of continued noncompliance charged as a separate offense. The unified government may also pursue any other lawful action, including injunctive relief, to stop or remedy the violation.

Frequently Asked Questions

Do I need a permit just to grade or fill land in the floodplain?
Yes. Section 27-550(a) defines development broadly to include grading, filling, dredging, and paving, and bars all such activity in a mapped flood zone unless a floodplain development permit is first issued by the unified government or its designee.
Who reviews floodplain permit applications in Wyandotte County?
The director of planning serves as floodplain administrator under § 27-551 and reviews every application, coordinates with the county engineer and the Kansas Division of Water Resources, and verifies the certified lowest-floor elevation before and after construction.
What happens if I build in the floodplain without a permit?
Section 27-554 classifies the violation as a misdemeanor carrying a fine of up to $500.00 plus court costs, with each additional day of noncompliance treated as a new, separately punishable offense.
