Chapter 457, Taxicabs and Taxicab Drivers, adopted December 9, 2008 by Ord. No. 4168-08 and administered through the Township Clerk's office, requires every taxicab and taxicab company operating on Toms River streets to hold an annual license; the Township Council caps the number of company licenses at 20, and the annual license fee is $270 with a $50 transfer fee (§§ 457-1, 457-2). " The three-minute cap ties directly into the statewide Air Pollution Control Code, which sets a general idling limit for diesel and gas vehicles, but here it is written into the taxicab driver's own duty-of-care rules rather than a general traffic ordinance.

The rule applies while a taxicab is parked, not while it is moving in traffic or actively loading a passenger. A driver who exceeds it is treated the same as any other equipment-responsibility violation under the chapter: no separate idling penalty is listed, so it falls under the chapter's general violations section, § 457-43, which sets fines of $100 to $500 and/or suspension or revocation of the taxicab license for violating any rule in Chapter 457.
