The Town of Oro Valley operates under an EPA Phase II MS4 stormwater permit administered by ADEQ. The Stormwater Management Program requires construction sites disturbing one acre or more to obtain an Arizona Pollutant Discharge Elimination System (AZPDES) Construction General Permit and implement a Stormwater Pollution Prevention Plan (SWPPP). Post-construction stormwater controls must retain the 100-year, 2-hour storm event on site using green infrastructure, retention basins, or other approved methods. The Town adopted water harvesting requirements in the Zoning Code that mandate new residential and commercial development capture rainwater for landscape irrigation. Illicit discharge to the storm drain system is prohibited -- the Town conducts dry-weather monitoring and inspects outfalls to Canada del Oro and Canaada del Oro Wash tributaries. Residents must not allow pool discharge, vehicle wash water, or landscape runoff containing fertilizers or pesticides to enter the storm drain system.
Illicit discharge violations carry fines of $250 to $2,500 per incident. Construction sites operating without an active SWPPP face ADEQ enforcement with penalties up to $25,000 per day under the Clean Water Act.
