Full Breakdown
Section 228-226 of the East Brunswick Township Code sets the height rules for every fence in the Township. Subsection B caps any fence on or around a lot at six (6') feet, except on industrially zoned properties. Pre-constructed fences must be installed as close to the ground as possible, and the total height does not count undulations of the ground as long as eighty percent (80%) of the fence does not exceed six (6) feet. Subsection I allows fences in the Planned Industrial Park (P-I) and Industrial/Manufacturing (I/M) zones up to eight (8) feet.
Subsection C controls the front yard of a residential lot. No fence can be erected there unless it is less than fifty percent solid and no greater than four feet in height. A four foot fence can be more than fifty percent solid if it is set back four feet from the front property line and a planted buffer goes in front of it at installation. The buffer consists of compact juniper, forsythia, compact euonymus or approved equal, subject to the approval of the Township Landscape Architect, installed three feet on center at a minimum height of 24 inches. Corner lots in residential zones can have fencing in one of the front yards up to 6 feet in height, but the fence can extend no more than half the distance between the nearest wall of the dwelling and the front property line, cannot extend beyond the nearest corner of the residence, and needs a planted buffer.
The corner visibility rule in § 228-223 applies in any district. On any corner, no fence, sign or other structure, planting or other obstruction to vision higher than two and one-half (2 1/2) feet above the existing street grade at the center line can stand within the line connecting points on the two street lot lines at a distance of twenty five (25) feet from the corner. Fences around a swimming pool follow § 195-12, and fences in Planned Unit Residential Developments are prohibited except under the standards set at P.U.R.D. preliminary approval under § 228-118.7.
Violations & Fines
Building a fence taller than the printed limit, or a solid front yard fence without the setback and planted buffer, is a violation of Chapter 228 that the Zoning Officer enforces under § 228-265. The owner, a contractor or anyone assisting can receive a summons. Section 1-15 sets a fine not to exceed $2,000, up to 90 days in the county jail or community service, and each day of violation is a separate offense.
