Fence height in Georgetown is regulated by Section 8.07.040 of the Unified Development Code (Residential Fences). For single-family, two-family and townhome uses, fences in a front yard are limited to four feet in height and must be at least fifty percent (50%) transparent, such as a wrought iron or picket fence (Sec. 8.07.040.A). Fences 'in all other locations' (typically side and rear yards) are limited to six feet but may be increased to a maximum of eight feet in listed circumstances under Sec. 8.07.040.C: if the adjacent use is non-residential, if the fence is in a rear yard not adjacent to a street and both owners consent, if it is more than 50% transparent overall (or 100% transparent above six feet), if topography requires extra height for privacy, or if it abuts a roadway with right-of-way wider than 120 feet. Fences directly abutting public alleys are limited to six feet. Per Sec. 8.07.030.D, fence height is measured from ground level on the higher side of the fence or wall. Apartment and non-residential fences are governed separately by Sections 8.07.050 and 8.07.070. These are city UDC rules, not Texas state law; Texas has no general statewide residential fence-height limit.
Building a fence taller than the limit for its location (for example a solid six-foot fence in the front yard, or an eight-foot fence in a location that does not qualify for the increase) is a UDC violation.
