The governing rule is Appendix B (Zoning Code), Section 10.3.L.1, part of the accessory structure standards. It splits a lot into two zones. The restricted zone runs from five feet behind the front building line forward to the front lot line, and it also takes in the corner side yard. In that zone a privacy fence or wall tops out at 42 inches, which is three and a half feet. An open fence in the same zone has no limit.
The code defines the two fence types in Article 2. An open fence has more than 50% of its entire surface made up of regularly distributed openings. A privacy fence has no distributed openings at all, a shadowbox design counts as a privacy fence, and a chain link fence with slats does not. So a slatted chain link fence in a front yard is treated as open, while a solid board fence is not.
Through lots get their own sentence. On the rear of a through lot, fences are limited to 42 inches when they sit closer to the street than the front setback for the zoning district, or closer than the average of the blockface for existing principal buildings numerically addressed along the parallel street, whichever is greater. Past that line, the rear of a through lot falls under the no-limit rule.
In other yards, meaning the side and rear yards behind the five-foot line, Section 10.3.L.1.b states there is no limit on the height of privacy fences, walls, or open fences. Fences may also be built right at the lot boundary with no setback, with one exception: the required visibility triangle. Article 2 defines that triangle as the area at the intersection of two streets, or a street and a private driveway, through which motorists need an unobstructed view of approaching traffic.
Separate, stricter numbers apply inside the Cumberland Avenue district. Section 7.2.7 caps a wall or fence in a primary or side street yard at 6 feet, requires opacity above 4 feet to exceed 50%, and caps a side or rear yard wall or fence at 8 feet. The Director of Plans Review and Building Inspections enforces the zoning code and can bring in the City Attorney to seek an injunction or abatement. Anyone who violates the code is fined upon conviction, each day the violation continues counts as a separate offense, and fines accrue under the amounts set in the Knoxville City Code until the violation is corrected.
