(See Appendices).

Full Breakdown

Fence and hedge heights are set by § 145-31 of the Millcreek Township Code. Subsection A caps a Solid Fence, enclosure wall or similar item at six feet, and at eight feet in a Commercial, Mixed Use or Industrial Zoning District. Along any Front Yard Street line, in any zoning district, a Solid Fence, enclosure wall, similar item or hedge in front of the Building front plane cannot exceed four feet.

The corner visibility rule is subsection B. A Solid Fence proposed in front of the Building front plane that sits within 15 feet of a driveway intersecting a front Property Line, or within 15 feet of the intersection of two front Property Lines, cannot exceed three feet in height above the center line of the adjacent Street surface. Subsection A says that when a fence is within 15 feet of a driveway, subsection B controls the height. For a Corner Lot, subsection C decides which side is the Front Yard by the address of the property.

Several other standards apply. An Ornamental Fence taller than the height allowed for a Solid Fence must keep the ratio of solid portion to no more than one to four. In a Residential Zoning District the finished side of a Solid Fence faces the Street. Fences built to the section are exempt from front, side and Rear Yard regulations, so they can be placed in a setback. Fences tied to Recreation Facilities (Commercial, Private or Public) inside the required Setback can exceed the district fence maximum, but never the maximum Building Height of the zoning district. Section 145-29 lets walls or fences serve as the buffer requirement, and § 145-34B requires a six-foot Solid Fence to screen outside storage that abuts a public Right-of-Way or a Residential Zoning District.

Violations & Fines

A fence over the printed height is a violation of Chapter 145 and draws an Enforcement Notice from the Township under § 145-114, giving the owner of record dates to start and finish compliance and notice of the right to appeal to the Zoning Hearing Board. If the owner fails to comply, a District Magisterial Judge can enter a $500 judgment for each violation plus court costs and reasonable attorney's fees, and each continuing day is a separate violation.

Frequently Asked Questions

How tall can a backyard fence be in Millcreek Township?
A Solid Fence, enclosure wall or similar item cannot exceed six feet outside Commercial, Mixed Use and Industrial districts, where the limit is eight feet. Section 145-31A also holds anything in front of the Building front plane along a Front Yard Street line to four feet, hedges included.
What is the sight triangle rule near driveways and corners?
Under § 145-31B, a Solid Fence in front of the Building front plane within 15 feet of a driveway that meets a front Property Line, or within 15 feet of the intersection of two front Property Lines, cannot exceed three feet above the center line of the adjacent Street surface. The Township Code refers readers to its Appendices for the illustration.
Which side of a corner lot is the front for fence purposes?
For purposes of § 145-31 only, the Front Yard of a Corner Lot is decided by the address of the property. That choice sets which frontage carries the four-foot limit in front of the Building front plane, so check the address side before building along either street.
Which way does the finished side face?
Whenever a Solid Fence stands in a Residential Zoning District in Millcreek Township, subsection E requires the finished side of the fence to face the Street. Fences built to § 145-31 are exempt from front, side and Rear Yard regulations, so the rule covers appearance, not setback distance.
