The City of Rio Rancho regulates fence height in Municipal Code Section 154.77(D), where the maximum height depends on where the fence sits on the lot. Fences allowed in the front setback area can reach a maximum of four feet. Fences built within the side yard setback, behind the front setback to the rear setback, can be a maximum of six feet. Fences built outside the setback area, within the buildable area of a lot, may reach a maximum of eight feet. The City's permit handout illustrates this as a 4-foot maximum in the front setback area and 6-foot maximum in the remaining yard area. Height is measured from grade where the fence is located, and the code (154.77(E)) expressly forbids berming dirt to gain height. Where a fence sits on a retaining wall, height is measured from the highest retained-soil grade behind the wall. On corner lots, fences within the clear sight triangle (defined in Section 154.03) may not exceed 30% solid along the line of sight, and the City's handout notes corner lots require engineer approval for the clear sight triangle. Because Rio Rancho is an incorporated city, these are city ordinances; New Mexico's adopted 2018 IRC (Section R105.1) only exempts fences six feet or less from a building permit but does not set height limits.
Fences exceeding the height allowed for their location, or violating the corner-lot clear-sight-triangle rule, may be declared a nuisance or hazard by the Development Services Department (DSD) or Traffic Safety Advisory Committee and must be brought into conformance or removed within 30 days (Section 154.77(H)).
