Wayne County, IN Fence Regulations: Height Limits (2026)

Wayne County's zoning ordinance regulates fence height as part of its yard projection standards rather than a stand-alone fence chapter. Section 156.541, titled 'Fences, Walks and Hedges,' opens by stating that these features 'may be located in required yards' subject to two height tiers. Subsection (A) sets the baseline: a fence, walk, or hedge that does not exceed four feet in height above the ground at any point may be located in any required yard, including the front yard facing the street. Subsection (B) then allows a taller barrier, up to six feet above ground level, but only in a required rear yard or side yard, not in the front.

In practice, that means a homeowner along a county road can build a four-foot fence across the front of the lot but must step back to a required side or rear yard before going higher, up to six feet, for privacy or a dog run. The ordinance's zoning boundary provisions in the neighboring Section 156.542 can further adjust yard depth where a lot borders a more restricted zoning district, which can shift where the four-foot and six-foot zones fall on an irregular or corner lot.

The Wayne County Zoning Inspector administers these height limits under Section 156.555, and building a fence over the applicable four-foot or six-foot cap in the wrong yard is an ordinance violation under Section 156.999, carrying a fine of $25 up to $2,500 per violation, with every day the oversized fence remains standing counted as its own violation. A property owner may appeal a Zoning Inspector's fence determination to the Board of Zoning Appeals under Section 156.575.
