Bensalem, PA Fence Regulations: Fence Permit Requirements (2026)

Section 232-583(e)(1) of the Bensalem Township Zoning Code states plainly that no fence or wall can be constructed without first obtaining a permit from the Township Department of Building and Planning, along with any other permits required elsewhere in the Code or by other applicable laws. The section carves out one narrow exception: no permit is required for the repair or renovation of all or part of a fence that already exists on the property. Because the permit rule sits inside Section 232-583, the same section that sets fence height limits (six and one-half feet generally, four feet within a front setback), material restrictions in subsection (d)(5), and the vision-obstruction rule in Section 232-584 for corner lots, the Building and Planning staff who review a fence permit application check the proposed height, material, and placement against those standards before issuing it.

Subsection (e)(2) repeals any inconsistent prior Township ordinance provisions, and subsection (e)(3) makes the fence section severable, so if a court strikes one part the rest of the permit and construction rules stay in force. New residential construction, additions, and any change to an apartment building's required boundary fence under subsection (d)(7) all fall under this same permit requirement before work begins.
