Middletown, OH Fence Regulations: Fence Permit Requirements (2026)

06(a) requires a certificate of zoning compliance and/or building permit before anyone constructs or erects a fence or wall in the City of Middletown, Ohio; the only exemptions are repairs of existing fences, replacements where the original permit can be produced, and invisible fences. 06(a)(3). 05, requires containment within the applicant's own lot lines, orients the finished (smooth) side outward, bars walls from utility easements, and lets utility companies or the City remove an easement-encroaching fence without notice at the owner's expense. 06(c) from the lowest point within three feet of the fence to its top, with posts allowed up to six inches taller.

Front-yard fences, walls and hedges are capped at 48 inches in residential districts and the O-1/O-2 districts, and at six feet elsewhere unless the fence meets the district's building setback. 06(d) further restricts material and style to wood, ornamental iron or aluminum, or vinyl resembling those materials, and expressly bans chain link, wire and barbed wire. The Development Code Administrator enforces compliance and can require the owner to correct any deviation from the approved plan.
