Middletown, OH Fence Regulations: Retaining Walls (2026)

02 of the Development Code, governing residential fences, does not set a maximum height or require an engineering permit for retaining walls, but division (b) does impose a companion fencing duty once a wall crosses a height threshold: any retaining wall that measures more than three feet above the lowest grade level it serves must be protected by a fence not less than four feet high. The code gives one relief valve, that required fence need only be three feet high, rather than four, once the retaining wall extends beyond the building line, meaning it sits further back from the street-facing part of the lot.

02 folds in the general residential fence standards that also apply to any fence built atop or alongside a retaining wall: no sharp-pointed toppers, height measured from a point no more than six inches above finished grade, contour-following construction where practical, drainage outlets at the base of solid fences to prevent stagnant water, and construction from masonry, metal, wood, natural plant material, or another substantial material. 02(f), so a wall-and-fence combination that clears the three-foot trigger is not automatically exempt from separate zoning setback or building-permit review.
