Parsippany-Troy Hills, NJ Fence Regulations: Fence Permit Requirements (2026)

Chapter 430 makes the zoning permit the first step for any structure. Under § 430-295 A, a zoning permit signed by the Administrative Officer is required as a condition precedent to the erection, construction, reconstruction, alteration, conversion or installation of a building or structure, certifying that it complies with the chapter. The same subsection bars any building permit from issuing until the zoning permit has been issued. Subsection B says no person may start work without first applying for and securing the permit from the Administrative Officer.

Subsection C requires an inspection by the Administrative Officer or an authorized representative before the permit is issued. If the fence or wall does not comply, subsection D directs the Administrative Officer to deliver written notice to the applicant explaining in what respects it fails. Section 430-294 adds that no permit is granted for construction that would violate the chapter, and that the Administrative Officer or a designee inspects premises suspected of violations and orders remedies in writing.

The fee sits in § 430-295 E(7): residential deck, patio, pool, shed, fence, wall or driveway, $50. The fee is paid on application to the Township.

The permit turns on the design rules in § 430-11. Fences and walls in the side and rear yard are limited to six feet in height, and in the front yard to four feet. No closed-type fence or wall may be erected in the front yard, and the code defines that as one with an open space between members of less than 50% of the width of the vertical slats or members. Necessary retaining walls for site grading are permitted in a front yard up to four feet, subject to sight triangle considerations and at least three feet of planted space between tiered walls, and they carry their own construction code permits. Fences surrounding pools must be at least four feet high and designed to state regulations.

Separately, Chapter 159 puts the duty to build, repair and maintain fences, walls and other safeguards that protect people from unsafe places next to Township streets on the abutting owner. The Township Council can order the work by resolution with a notice of not less than 30 days, and the Director of Public Works supervises any work the Township performs and bills to the owner.
