Fire pit rules in Edison, NJ β also called outdoor burning, recreational fire, or open flame ordinances β cover fuel types, clearances, and when burning is allowed.
Edison Township regulates recreational fires under Chapter 16 (Fire Prevention and Protection) of the Township Code, which adopts the New Jersey Uniform Fire Code (N.J.A.C. 5:70). Recreational fires are allowed if the fuel area stays under 3 ft diameter Γ 2 ft height, the fire is located 25 ft from any structure (15 ft if in an approved container), only seasoned firewood is burned, and a responsible adult with extinguishing equipment is present at all times.
Edison Code Chapter 16 adopts the New Jersey Uniform Fire Code in its entirety and adds local enforcement provisions. A 'recreational fire' under the NJ Uniform Fire Code is an outdoor fire burning materials other than rubbish with a total fuel area of 3 feet (914 mm) or less in diameter and 2 feet (610 mm) or less in height for pleasure, religious, ceremonial, cooking, warmth, or similar purposes. Recreational fires must be at least 25 feet from any structure or combustible material. If the fire is built in an approved container (commercially manufactured fire pit, chiminea, or fire bowl), it may be located 15 feet from a structure. Bonfires - any open fire larger than the recreational-fire size - require a Type 1 permit from the Edison Fire Prevention Bureau with at least 10 days' advance written notice; the bonfire may not exceed 5 ft Γ 5 ft Γ 5 ft and must burn for no more than 3 hours. Fuel is limited to seasoned dry firewood; burning rubbish, leaves, treated lumber, or construction debris is prohibited.
Violations of Chapter 16 or the NJ Uniform Fire Code are punishable by administrative fines under the Uniform Fire Safety Act, typically $100 to $500 per first offense and increasing for repeat offenses. The Edison Fire Prevention Bureau may order immediate extinguishment of any non-conforming fire and bill the responsible party for fire-department response if the fire requires suppression.
