Outdoor burning rules in Edison, NJ β also called the burn ban, open burning, or fire restriction ordinance β set when you can burn yard waste, debris, or run a recreational fire.
Open outdoor burning of yard waste, leaves, brush and refuse is prohibited in Edison Township under the New Jersey Air Pollution Control Act and DEP Air Quality rules at N.J.A.C. 7:27-2.1 (Open Burning). Statewide, open burning is banned except for narrowly defined exemptions (recreational fires, prescribed forestry burns by NJFFS, agricultural burning with a permit). Edison enforces the state ban through the Fire Prevention Bureau and Health Department.
Open burning in New Jersey is regulated at the state level under the Air Pollution Control Act and NJDEP rules at N.J.A.C. 7:27-2.1, which prohibits open burning of refuse, building materials, leaves, brush, vegetation, and trade waste statewide. The only exemptions are: (1) small recreational fires that comply with IFC Β§308.1.4 as adopted into the NJ Uniform Fire Code; (2) prescribed forest fires conducted by or with permission of the NJ Forest Fire Service; (3) certain agricultural burning of crop residue with a DEP permit; (4) fires for training of firefighting personnel; and (5) ceremonial fires conducted under a DEP-issued permit. Recreational cooking with charcoal or LP/natural gas grills is not 'open burning' and is unrestricted. In Edison Township, the rule means residents may not burn leaves, yard waste, brush piles, construction debris, or trash on their property β these must go to municipal yard-waste collection, the Middlesex County Improvement Authority transfer/landfill, or be composted on-site. Edison's Fire Prevention Bureau and Health Department respond to open-burning complaints; NJDEP can pursue additional state penalties under the Air Pollution Control Act.
Open burning of prohibited materials violates N.J.A.C. 7:27-2.1 and is enforceable by NJDEP under the Air Pollution Control Act with civil administrative penalties of up to $10,000 for a first offense and higher for repeated violations. Edison Fire Prevention may also cite under the NJ Uniform Fire Code (N.J.A.C. 5:70-2.12) with civil penalties up to $5,000 per violation per day. Costs of fire-department response and suppression may be recovered from the responsible party.
