Buckeye City Code section 10-2-8 makes it unlawful to discharge fireworks except permissible consumer fireworks during set windows: May 4-6, June 24-July 6, December 24-January 3, and the 2nd and 3rd days of Diwali. Use is banned 11:00 p.m.-8:00 a.m. except New Year's Eve and July 4. Aerial/exploding fireworks are not permissible.
Buckeye regulates fireworks under section 10-2-8 (Discharge or Ignition of Fireworks) in Chapter 10. It is 'unlawful for any person, other than those parties engaged in a supervised public display, to use, discharge or cause the ignition of fireworks within the corporate limits of the city, except that the use of permissible consumer fireworks shall be allowed from May 4 through May 6, from June 24 through July 6, from December 24 through January 3, and on the second and third days of Diwali each year.' A separate nighttime limit makes it unlawful to use permissible consumer fireworks between 11:00 p.m. and 8:00 a.m. on any day, except that use is allowed from 11:00 p.m. on December 31 through 1:00 a.m. on January 1, and from 11:00 p.m. through July 4 to 1:00 a.m. on July 5. During a stage one or higher fire restriction, fireworks may not be used within a one-mile radius of any municipal/county mountain preserve, desert park, regional park, conservation area, national forest, or wilderness area. Novelty items and permitted supervised public displays are exempt. These windows track Arizona's state fireworks law (A.R.S. sections 36-1601 and 36-1606) for counties with 500,000+ residents, which includes Maricopa County.
Where Chapter 10 states no specific penalty, violations are subject to the civil and criminal penalties in Article 1-7 of the city code. The Buckeye Police Department has publicly described unlawful fireworks discharge under 10-2-8 as a class 3 misdemeanor. Sellers must also post state regulation signs.
