Chesapeake prohibits most consumer fireworks under local ordinance, despite VA Code 27-97 permitting certain types statewide. Only sparklers and non-aerial fountains are allowed. Aerial and exploding fireworks banned.
Virginia Code 27-97 authorizes localities to regulate fireworks, and Chesapeake has enacted City Code Chapter 30 (Fire Prevention) prohibiting the sale, possession, and use of most consumer fireworks. Permitted items under Virginia law that remain legal in Chesapeake are limited to ground-based, non-aerial, non-explosive sparkling devices such as handheld sparklers, cylindrical fountains, cone fountains, wheels, and illuminating torches. Firecrackers, skyrockets, Roman candles, aerial shells, and any device that explodes or travels more than a few feet are prohibited. The Chesapeake Fire Marshal enforces fireworks rules, especially heavily around July 4th and New Year. Permits for public displays may be issued to licensed pyrotechnicians. Extra patrols run during holiday periods and offenders receive citations.
Possession or discharge of illegal fireworks is a Class 1 misdemeanor, punishable by up to 12 months jail and $2,500 fine. Fireworks are typically confiscated.
