Sec. 38-68 carves out a short list of exempt items: toy caps for cap guns packed under DOT rules, model rockets and motors used to propel recoverable aero models, and propelling charges of sulfur, charcoal and saltpeter not designed to produce an audible effect. Everything else runs through the display-permit process in Sec. 38-69, which lets the city fire department license supervised fireworks displays for municipalities, fair associations, amusement parks and similar groups after an application, a bond, and an inspection, with a competent operator certified by the fire department required to handle the display and the board of commissioners weighing in on hazard to persons or property; the permit cannot be transferred.

Sec. 38-70 requires the applicant to prove financial responsibility for property damage or injury claims before the permit issues. Sec. 38-71 lists activities the article never touches regardless of a permit: wholesale sales to approved manufacturers, dealers or jobbers under federal ATF and DOT rules, manufacturing and testing at a licensed facility, industrial pyrotechnics such as railroad torpedoes and marine flares, blank cartridges for shows or sports, military and law-enforcement pyrotechnic use and training, and agricultural fireworks use supervised by the Department of the Interior or an equivalent agency.
