Full Breakdown
Article V of Chapter 16 is titled the Fireworks Enforcement Code (§ 16-121). Section 16-123(a) prohibits the use or sale of fireworks in the city, including consumer fireworks and display fireworks, at all times except as the article sets out. The code defines use to include igniting, firing, exploding or possessing with the intent of use, and sale to include offering, exposing or keeping with the intent to sell. Under subsection (b) the prohibition does not apply to consumer fireworks as defined in KRS 227.702(1), although their sale is regulated by the article. Display fireworks as defined in KRS 227.706 need the written approval of the city fire marshal or his designee plus all other necessary permits, and the government can require the applicant to reimburse its reasonable costs, including overtime of government personnel.
Section 16-124 sets the conditions for any lawful use. Fireworks and consumer fireworks can be fired only between 10:00 a.m. and 10:00 p.m., except that the ending hour is 12:00 midnight on December 31 (New Year's Eve), July 3, July 4, and the date the city designates to celebrate Independence Day if other than July 4. No person under 18 years of age can possess, use, ignite, fire or explode fireworks or consumer fireworks as defined in KRS 227.702(2) and (3). Firing is barred within 200 feet of any structure, motor vehicle or other person, and during any ban on burning issued by the state or county. Anyone who fires fireworks is responsible for disposing of the resulting trash or debris.
Seasonal fireworks retailers, who sell only between June 10 and July 7, must first obtain a retail fireworks permit from the mayor or his designee (§ 16-125). The application, in a form approved by the city fire marshal, is due at least 15 business days before the desired effective date, and each sales location needs its own permit. Proof of state fire marshal registration and approval from the city fire department are required. The fire marshal, fire inspector or any law enforcement officer can issue citations under KRS 83A.087 (§ 16-130).
Violations & Fines
Violating the Fireworks Enforcement Code is a misdemeanor punishable by a fine of not more than $1,000.00 or imprisonment for not more than six months, or both, and each day a violation occurs is a separate offense (§ 16-129). The minimum fine for selling prohibited fireworks is $500.00. For use, the minimum is $100.00 for a first offense within any 12-month period, $250.00 for a second, and $500.00 for a third or greater offense. Officers can also order violating uses, practices or operations to cease and desist immediately.
