Full Breakdown
Article IX of Chapter 38 sets Georgetown's snow emergency and snow removal rules. Section 38-180 incorporates the Georgetown Snow Removal Management Plan, as amended by the city council, and Section 38-181 sorts all city streets into five categories: state-maintained routes, snow emergency routes, secondary streets, tertiary streets and private streets. The map in the snow plan is the official record of street designations, so a driver checks that map to learn whether a street is an emergency snow route.
Section 38-182(a) bans parking any vehicle, trailer, storage container or equipment on a street designated as an emergency snow route during a declared snow emergency. Section 38-182(b) applies to any snow event: no person can permit a vehicle, operational or disabled, to remain on the traveled portion of the street, unless the person is actively attempting to remove it.
Property owners carry their own duties. Occupants of property with a fire hydrant must, within 24 hours following a snowfall, clear a three-foot clearance encircling the hydrant and a four-foot wide access path from the street (Section 38-184). Placing snow on any traveled street, alley, sidewalk or driveway constructed as a continuation of sidewalk is unlawful (38-185), and occupants clear the snow windrows at the foot of their driveways while owners of private property clear windrows at the entrance to the public street (38-186). The city plows streets platted for dedication but not yet accepted only if the responsible entity signs a liability waiver; otherwise that entity clears the street within 24 hours after final snowfall or ice accumulation, and the city provides no snow removal on private streets (38-183). Section 38-187 makes anyone served by the exclusive trash franchise responsible for keeping containers accessible to crews and automated equipment during snow and ice. Section 38-189 lets the city contract with private persons for snow removal when conditions require.
Violations & Fines
Under Section 38-188 the Georgetown Police Department can remove any vehicle, truck, trailer, storage container or equipment parked in violation of Section 38-182, or engage a wrecker, at the owner's or operator's expense, or issue a parking prohibited citation instead. Hydrant, snow placement and windrow violations are nuisances enforced under Chapter 26, and container violations are nuisances enforced under Section 40-28. The citation schedule in Section 38-202 lists parking prohibited at $25.00.
