Full Breakdown
Georgetown's curb color rule is short. Section 38-109(a)(7) prohibits any person from stopping, standing or parking a vehicle at any place where the curb is painted yellow. The Code names no other curb color and prints no length for a yellow zone. A catch-all in (a)(21) prohibits stopping, standing and parking at any place where official signs and/or markings prohibit it, which puts other official pavement and curb markings under the same rule. The prohibition carries the same exceptions as the rest of subsection (a): stopping necessary to avoid conflict with other traffic, or in compliance with the law or the directions of a police officer or traffic-control device.
The authority to mark belongs to the city engineer. Section 38-100(c) authorizes the engineer to erect and maintain appropriate signs, devices, marks and lines upon any street in the city to indicate the traffic regulations, where the engineer, in consultation with the traffic committee as necessary, determines particular hazards exist or where unusual delay in traffic exists. Section 38-100(b) adds the power to determine and designate no parking areas and limited parking areas.
Fire lanes work differently from yellow curbs. Under § 38-107 the city engineer, after proper traffic survey and with the approval of the mayor, police chief and fire chief, can establish fire lanes on any street where a particular hazard exists, and under § 38-108 a curb that is properly signed as a fire lane makes it a violation for anyone to park a vehicle at any time. Fire lane violations are fined at $50.00, double the yellow curb figure.
Section 38-109(c) authorizes any police enforcement officer or citation officer to issue citations, and § 38-204 lets the city impound a vehicle parked in violation of the chapter.
Violations & Fines
Section 38-202 lists a yellow curb fine of $25.00. The fine is due within 14 calendar days of the citation and doubles if it is not paid by the fourteenth day. If it remains unpaid 30 days after the citation, the vehicle owner is summoned to Scott District Court and can be assessed fines and court costs, and the registered owner is liable for all fines, fees and penalties under § 38-203.
