Full Breakdown
Section 38-109(a) is the master list of no-stopping, no-standing and no-parking places. It applies in addition to KRS 189.450(5), and it excuses a driver only when stopping is necessary to avoid conflict with other traffic or in compliance with the law or the directions of a police officer or traffic-control device. Among its 21 places: upon a sidewalk, within five feet of a fire hydrant, in a place that blocks any residential or public U.S. Postal Service mailbox, on a crosswalk, within an intersection, within three feet of a garbage can placed at the edge of the roadway for collection, and on any emergency snow route when accumulation is over two inches deep.
Position at the curb is regulated as well. Subsection (a)(16) bars standing in a public street except near the right-hand curb, (a)(17) bars parking with the left side of the vehicle to the curb except on a one-way street, and (a)(18) requires a vehicle to be parallel with the edge of the roadway, headed in the direction of lawful traffic movement, with the right-hand wheels within 12 inches of the curb or edge. Section 38-118 separately bars standing or parking on the left-hand side of a one-way roadway unless signs are erected to permit it.
Width and spacing rules sit beside the list. Under § 38-111 no one parks on a street, other than an alley or one-way street, so as to leave less than 20 feet of roadway width for free movement of traffic. Section 38-112 sets ten feet for alleys and one-way streets. Section 38-105 prohibits double parking on the streets, avenues, alleys and other public ways, and § 38-110 requires parking within the marked lines with no wheel on or across a line.
Subsection (b) adds that no person shall move a vehicle not owned by that person into a prohibited area, and subsection (c) authorizes any police enforcement officer or citation officer to issue citations for violations of the section.
Violations & Fines
Owners are cited under Article XI. Section 38-202 sets $25.00 for parking prohibited, improper parking, double parking, blocking an alley, blocking a driveway and tow zone, and $50.00 for fire hydrant and fire lane. The fine is due within 14 calendar days, after which it doubles. If it is unpaid after 30 days the owner is summoned to Scott District Court and can be assessed fines and court costs. Section 38-204 lets the city impound a vehicle parked in violation, and § 38-203 makes the registered owner liable.
