A.R.S. 36-1606 limits Arizona municipalities to regulating only the use, not sale, of permissible consumer fireworks and prohibits aerial fireworks statewide.
Arizona Revised Statutes 36-1606 establishes statewide standards for consumer fireworks. Permissible items include ground and handheld sparkling devices, snakes, smoke devices, and similar non-aerial novelties. Aerial fireworks (bottle rockets, mortars, Roman candles) remain illegal for general consumer use statewide. Cities and counties may regulate the use, but may not ban the sale, of permissible consumer fireworks. Permissible periods are May 20 to July 6 and December 10 to January 3.
Use of prohibited aerial fireworks is a petty offense; reckless use causing injury or fire damage may be charged as a misdemeanor or felony.
