Municipal Code Article III (Secs. 11-146 to 11-150) makes it unlawful to possess, use, or sell aerial devices and ground audible devices such as missile rockets, helicopters, aerial spinners, chasers, and firecrackers. Permissible fireworks are limited to ground-based items legal under NMSA 1978, Sec. 60-2C-7, sellable June 20 to July 6, around New Year's, Chinese New Year, September 16, and Cinco de Mayo. Manufacture of fireworks is prohibited citywide (Sec. 11-149). During extreme or severe drought, the City Council may proclaim additional restrictions confining fireworks to paved, barren, or watered ground (Sec. 11-148).
Petty misdemeanor under Sec. 11-150 and Sec. 1-10: up to $500 fine and/or 90 days in jail. Illegal aerial and audible fireworks may be seized.
