Subsection (c) makes it unlawful to possess, use or sell any aerial device or ground audible device as defined in NMSA Sections 60-2C-7(A)(2) and (A)(3), the categories the state itself classifies as the most restricted consumer fireworks. What is left, 'permissible fireworks' under Section 11-146, may be sold at retail only between June 20 and July 6, during the six days up to and including New Year's Day, three days up to and including Chinese New Year, September 16 and Cinco de Mayo, except that stores whose primary business is tourism can sell year-round.

Temporary sales stands cannot go up more than a week before an approved sales period and must be dismantled within a week after it ends, under subsection (d). S. Forest Service drought indices, the council can proclaim additional bans, including on missile-type rockets and ground audible devices already restricted, and can extend the ban to all otherwise-permissible fireworks in a proclamation effective for 30 days. Manufacturing fireworks anywhere within the city is separately prohibited outright under Section 11-149, with no seasonal or retail exception. Section 11-150 makes any violation of the entire fireworks article punishable under the Code's general penalty section.
