All fireworks (including state-approved 'safe and sane') are prohibited in the State Responsibility Area covering Eastern Madera County. In the valley portion of the unincorporated county, only Cal. Under California Public Resources Code §4422 and the County's fire ordinance, possession or discharge of any fireworks (including 'safe and sane') is prohibited within the State Responsibility Area, which covers Eastern Madera County, Mariposa County, and portions of Merced County. In the valley portion of unincorporated Madera County, only fireworks labeled 'Safe and Sane' by the California State Fire Marshal are allowed, and only during the legal Fourth of July sales/use window set by the County. All other fireworks (skyrockets, firecrackers, bottle rockets, M-80s, mortars, sparklers exceeding state limits) are illegal anywhere in California under Cal. Health & Safety Code §12500 et seq. Madera County's social-host-style ordinance also allows citation of the property owner where illegal fireworks are discharged.
Each illegal firework is cited individually, with potential fines reaching thousands of dollars for multi-firework incidents. State law (H&SC §12700) makes possession of dangerous fireworks a misdemeanor; injury or death from illegal use can trigger felony charges. Property owners can be cited even if they did not personally ignite the fireworks.
