Under Minn. Stat. 624.20-624.25, the legal 'consumer fireworks' Minnesotans may buy and use are limited to non-explosive, non-aerial novelties: wire/wood sparklers up to 100 grams, other non-explosive non-aerial sparkling items (cones, fountains, ground spinners) within weight limits, snakes, glow worms, smoke devices, and trick noisemakers. Anything that flies or explodes - firecrackers, bottle rockets, Roman candles, skyrockets, mortars - is prohibited statewide. Buyers must be 18, and use on public property is barred. Maple Grove City Code Chapter 18 (amended by Ordinance 20-07, adopted May 18, 2020) addresses fireworks directly. Sec. 18-97 (amending MSFC 7801.3.1.4) defines 'fireworks' and 'legal consumer fireworks' by reference to Minn. Stat. 624.20, expressly excluding string poppers, party poppers and snappers, and states legal consumer fireworks may be sold only upon a license issued by the city. Sec. 18-95 (amending MSFC 7801.3.1.1) provides that manufacturing of fireworks is prohibited within the boundaries of the city. The city's policy and statute together mean residents can use sparklers and ground-based fountains but not aerial or exploding fireworks. Cities can limit or prohibit use but cannot ban licensed sales.
Most fireworks violations under Minn. Stat. 624.20-624.25 are a misdemeanor (up to 90 days jail and/or a $1,000 fine). Violations involving 35 pounds or more (gross container weight) can be charged as a gross misdemeanor (up to one year jail and/or a $3,000 fine). Selling without the required city license, or manufacturing fireworks in the city, violates Chapter 18.
