Smoke alarm requirements in Maple Grove come mainly from Minnesota law. Minn. Stat. 299F.362 requires a smoke alarm in every dwelling unit per the State Fire Code, and new dwellings must have alarms hardwired to a central power source. Maple Grove adopts the current Minnesota State Fire Code (City Code Sec. 18-71) and requires alarm systems kept operational (Sec. 18-85).
Maple Grove's smoke-detector rules flow from Minnesota statute and the adopted State Fire Code rather than a unique city numeric standard. Minn. Stat. 299F.362, subd. 3, requires that every dwelling unit within a dwelling be provided with a smoke alarm meeting the requirements of the State Fire Code, mounted per rules adopted by the Commissioner of Public Safety. Subd. 3a requires that in the construction of a new dwelling, each smoke alarm be attached to a centralized power source (hardwired). The statute also requires occupants of rental units to notify the owner within 24 hours of discovering a non-functioning alarm. Maple Grove City Code Sec. 18-71 (Ordinance 20-07) adopts the most current Minnesota State Fire Code, as modified by Minnesota Rules Chapter 7511, as the fire code for the city, which carries the State Fire Code's detection and alarm provisions. City Code Sec. 18-85 (amending MSFC 901.6.3) requires that fire alarm systems, smoke and heat ventilators and other fire-protective systems be maintained in operative condition at all times and replaced or repaired when defective, with annual inspection/testing reports for applicable systems delivered to the Maple Grove Fire Prevention Bureau. Carbon monoxide alarms are separately required by Minn. Stat. 299F.50-299F.51.
Under Minn. Stat. 299F.362, subd. 6, smoke-alarm violations are subject to the same penalty and enforcement as a State Fire Code violation, and willfully disabling an alarm so it is non-functioning, resulting in damage or injury, is a misdemeanor. Maple Grove enforces fire-code maintenance requirements under Chapter 18 (Sec. 18-73) as a misdemeanor.
