Outdoor burning rules in Maple Grove, MN — also called the burn ban, open burning, or fire restriction ordinance — set when you can burn yard waste, debris, or run a recreational fire.
Open burning of natural vegetation (other than recreational fires) requires a city open burning permit under City Code Sec. 18-78, following Minnesota DNR guidelines. Burning leaves, grass, brush, garden debris and all non-vegetative materials is prohibited. Open burn fires must be 600 ft from any occupied structure on adjoining property and conducted only when winds are under 20 mph.
Maple Grove draws a sharp line between recreational fires and open burning. Under City Code Sec. 18-78 (Ordinance 20-07, amending MSFC Section 307), burning natural vegetative materials other than a recreational fire requires an open burning permit, issued following guidelines established by the Minnesota DNR, Division of Forestry. The city adopts Minn. Stat. Chapter 88 by reference for open burning definitions, conditions and permits. Critically, the ordinance prohibits open burning of leaves, grass, garden debris, brush, noxious weeds, diseased trees and nursery stock - these common yard-waste materials may not be burned. Brush piles and bush/scrub debris are also treated as yard waste and may not be burned. Vegetative material moved to the site from elsewhere (beyond the immediately adjacent same-parcel area) may not be burned, and prohibited materials include treated/painted/stained/glued wood, plywood, particle board, construction debris, furniture, household items, motor vehicles, oils, rubber, plastics, tires, railroad ties, paint and household garbage. For permitted open burns, the fire must be at least 600 feet from any occupied structure on adjoining property, not within 100 feet of any overhead power line or aboveground fuel tank, and not within 300 feet of piled combustible material. Wind speed must not exceed 20 mph while burning. The permit holder is liable for any damage, and the Fire Chief may require a certificate of insurance.
Burning prohibited materials, burning without a required open burning permit, or violating permit conditions is enforceable under Chapter 18 as a misdemeanor (Sec. 18-73). Negligently or carelessly starting a fire, or starting one without a permit, is a misdemeanor (Sec. 18-76). The permit holder is liable for damages caused by an open burning fire.
