(e) Within 150 feet of a building or vehicle, whether or not the building or vehicle is owned by the user of the Consumer Fireworks. ... (4) Time limitations. Consumer fireworks may not be used between the hours of 10:00 p.m. and 10:00 a.m., except: (a) On July 2, 3 and 4 and December 31, when Consumer Fireworks may be used until 1:00 a.m. the following day;

Chapter 40, Article IX of the Millcreek Township Code, adopted 6-13-2023 as Ord. No. 2023-5, regulates fireworks in Millcreek Township. Under § 40-67B a person must be at least 18 to purchase, possess and use Consumer Fireworks. Use is barred on private or public property, including streets, parking lots, sidewalks and parks, without the express permission of the owner or controlling entity. It is also barred within, directed at or directed from a vehicle or building, directed at another person, while the user is under the influence of alcohol, a controlled substance or another drug, and within 150 feet of a building or vehicle, whether or not the user owns it. No one can use Consumer Fireworks within 150 feet of an animal housing facility or fenced livestock area owned or managed by another person. At 150 to 300 feet the user must notify the owner or manager in writing at least 72 hours in advance.
Use is barred between 10:00 p.m. and 10:00 a.m., except until 1:00 a.m. the following day on July 2, 3 and 4 and December 31. When July 4 falls on a Tuesday, Wednesday or Thursday, use runs until 1:00 a.m. on the immediately preceding and following Friday and Saturday. Memorial Day and Labor Day, each with the immediately preceding Saturday and Sunday, are also listed exceptions.
Sales under § 40-67A are limited to facilities licensed by the Department of Agriculture. Each must be a stand-alone, permanent structure with a monitored burglar and fire alarm system and must comply with NFPA 1124. A facility licensed under 3 Pa.C.S.A. § 1108(a) must sit at least 300 feet from a facility selling or dispensing gasoline, propane or other flammable products and at least 2,500 feet from another licensed consumer fireworks facility. Under § 40-66, display fireworks need a Township permit, a competent operator at least 21 years old, liability insurance of not less than $1,000,000 naming the Township, and an application to the Fire Chief or Fire Marshal at least 30 days before the display.

Under § 40-69, using Consumer Fireworks in violation of the article is a summary offense with a fine of not more than $500, and a repeat offense within three years carries a fine of not more than $1,000. Selling Consumer Fireworks in violation is a second-degree misdemeanor with a fine of not less than $10,000, rising to not less than $15,000 and license revocation for a repeat within three years. Selling or using Display Fireworks in violation is a third-degree felony with a fine of not less than $10,000, and not less than $15,000 for a repeat. The Police Department and the Code Administrator enforce the article.
