Consumer fireworks are prohibited within the City of New Orleans and Orleans Parish under Chapter 26 of the Municipal Code. Although Louisiana law (LA RS 14:14 and related statutes in Title 51) allows the sale and use of consumer fireworks during designated holiday periods statewide, the framework expressly authorizes parishes and municipalities to impose stricter local rules. Orleans Parish, which is coextensive with the City of New Orleans, has chosen to ban consumer fireworks entirely under Chapter 26 of the Municipal Code.
Within city limits, it is unlawful to sell, possess, or discharge consumer fireworks at any time of year, including New Year's Eve and Independence Day. Sparklers and other novelty items that meet the federal definition of fireworks are also generally prohibited. Violations are misdemeanor offenses subject to fines and possible confiscation. NOPD and the New Orleans Fire Department respond to fireworks complaints, particularly during the December and July holiday periods when activity is highest.
Professional pyrotechnic displays at events such as Mardi Gras, Independence Day on the riverfront, and major festivals are permitted only when conducted by a licensed pyrotechnician under a permit issued by the State Fire Marshal and reviewed by the New Orleans Fire Department. Residents looking to use consumer fireworks must travel outside of Orleans Parish to a parish that allows them, such as portions of St. Bernard, Plaquemines, or Jefferson Parish during the legal sale windows around July 4 and New Year's.
