Escambia County, FL Fire Regulations: Fireworks (2026)

Florida Statute 791.08 (as amended by SB 140 in 2020) legalized the use of consumer fireworks statewide, but only during three 'designated holidays.' On any other date, Escambia County Code Sec. 50-1 prohibits the use or explosion of fireworks countywide, in both incorporated Pensacola and the large unincorporated areas (Pensacola Beach, Perdido Key, Warrington, Brent). During a declared burn ban, even state-law-exempt items such as sparklers, snakes, smoke devices, party poppers and snappers are also prohibited. Authorized public fireworks displays and state-licensed fireworks sales remain exempt. Year-round 'sparklers' listed on the State Fire Marshal's approved list are legal outside a burn ban, but true aerial/explosive fireworks are lawful only on the three holidays.
