Arizona law allows the sale of permissible consumer fireworks, but Sahuarita and Pima County restrict their use. The dry Sonoran Desert climate and wildfire risk make fireworks enforcement a significant public safety priority.
Arizona Revised Statutes Section 36-1601 through 36-1614 regulate fireworks statewide. Permissible consumer fireworks include ground-based sparklers, cone fountains, and novelty items that do not explode or leave the ground. Aerial fireworks, firecrackers, bottle rockets, roman candles, and similar devices are illegal for consumer use statewide. Pima County has adopted additional restrictions, and the Sahuarita Fire District may impose complete fireworks bans during periods of elevated fire danger, which encompasses much of the dry season from April through June. Even permissible fireworks should not be used near dry desert vegetation, which ignites readily. The dry climate, combined with native grasses and brush that cure out during the pre-monsoon season, creates significant fire risk from any sparking device. Fireworks-related fires can spread rapidly in the Sonoran Desert landscape. Sahuarita Police and the fire district jointly enforce fireworks regulations, particularly around Independence Day and New Year celebrations. Rancho Sahuarita HOA prohibits all fireworks use within the community, and violations are enforced through HOA fines.
Illegal fireworks possession is a Class 2 misdemeanor. Use during a ban period carries enhanced penalties. Civil liability for any fire damage caused. HOA fines for any fireworks use in Rancho Sahuarita.
