Tigard, OR Fire Regulations: Fireworks (2026)

Chapter 7.84 of the Tigard Municipal Code, adopted by Ord. 22-05, makes fireworks a city offense in the City of Tigard rather than leaving the subject to state rules alone. Section 7.84.020.A prohibits selling, keeping or offering for sale, exposing for sale, possessing, using, exploding, or having exploded any fireworks within the City of Tigard, or allowing such conduct to occur. The only carve-out is conduct authorized pursuant to ORS 480.120 to ORS 480.124.

Section 7.84.010 sets the vocabulary. Fireworks has the meaning given in ORS 480.111. A person means an individual or business entity, so a company that stocks or sells fireworks is covered the same as a resident. The section also defines a red flag warning as the warning issued by the National Weather Service indicating extreme fire danger as a result of conditions such as drought, high temperature, low humidity, high or erratic winds, and dry vegetation and fuel.

Property owners and tenants carry their own exposure. Under § 7.84.020.B, a person commits the offense of allowing conduct if the person authorizes or permits fireworks use on real property that they own or control. A rebuttable presumption exists that the owner or tenant has authorized or permitted the conduct if the owner or tenant is present at the time of such conduct. That presumption shifts the burden to the owner or tenant who is on the property when fireworks are used.

The chapter once had a third section, § 7.84.030, but the code now prints it as Reserved and notes that Ord. 24-02 repealed it on 4/2/2024. The operative prohibition and the penalty both sit in § 7.84.020.
